Legislative Progress on Crypto Regulation

A recent U.S. Senate roundtable, hosted by Senator Marsha Blackburn and attorney Andrew Gordon, brought together industry leaders and policymakers to discuss the future of cryptocurrency regulation and AI-driven financial innovation. Senators Tim Scott, Cynthia Lummis, Bernie Moreno, Bill Hagerty, and Marsha Blackburn provided updates on upcoming legislation aimed at creating a more crypto-friendly environment in the U.S.

Senator Tim Scott announced that a stablecoin bill and a broader market structure framework are expected to pass within the next 100 days. This legislation aims to provide regulatory clarity for the industry, addressing key concerns around stability and market operations.

Tax Reforms to Support Crypto Adoption

Senator Cynthia Lummis highlighted significant tax reforms, including proposals to delay taxation on mining and staking rewards until they are sold. The legislation also seeks to repeal the unworkable broker rule and introduce a $600 de minimis exemption for crypto transactions, simplifying compliance for everyday users.

Lummis also discussed the market structure bill, based on the Lummis-Gillibrand framework, which aims to reduce regulatory ambiguity. The bill refines the Howey test to ensure that assets classified as commodities or securities maintain their status without arbitrary reclassification.

Addressing Regulatory Barriers for Tokenized Assets

Cloris Chen, CEO of Singularity Finance, emphasized the challenges of tokenised real-world assets (RWA) under current U.S. regulations. She called for a clearer framework to integrate tokenised RWAs into the financial system without excessive compliance burdens.

Chen highlighted that the lack of clarity in the security definition and the complex regulatory process are hindering innovation. She noted that tokenised AI assets and Treasury bills cannot currently be offered to U.S. investors due to the risk of being classified as securities, which would require SEC registration. This process is both lengthy and expensive, making it economically unfeasible to serve U.S. investors.
